1. Who we are
This website, www.bergopro.com, is operated by BERGO PRO Building Materials Trading LLC (“BERGO PRO”, “we”), Trade Licence No. 1095594, Warehouse L12, Phase 1, Dubai Industrial City, Dubai, United Arab Emirates. 2. What this website is for
We sell to trade customers: furniture manufacturers, joinery workshops, fit-out contractors, dealers and interior designers. The website shows our product range and lets registered trade customers send us a request for quotation. The website does not take payment and does not conclude a sale; every sale is made under a written quotation and our order confirmation.
3.Trade accounts
You may register for a trade account by submitting the sign-up form with a valid trade licence. We approve accounts at our discretion and may suspend or close an account that is misused. You are responsible for keeping your login details confidential and for all activity under your account.
4. Prices shown to trade customers
Prices shown to approved trade customers are estimates in UAE dirhams, exclusive of VAT, delivery and any duties, and are indicative only. Due to the current regional situation, prices may be subject to additional charges. The price, availability and delivery terms that apply are those stated in our written quotation, which prevails over anything shown on the website.
5. Requests for quotation and orders
A request sent through the website is an enquiry, not an order. We reply with a quotation. A contract is formed only when we issue an order confirmation after receiving your written acceptance of the quotation (and any advance payment it requires). Quotations are valid for the period stated on them, or 7 days if none is stated.
6. Payment
Payment terms are stated in the quotation. Unless agreed otherwise in writing, goods are paid for before delivery. VAT is charged at the rate applicable in the United Arab Emirates. Title to the goods passes on receipt of full payment.
7. Delivery
Delivery dates in quotations are estimates given in good faith. Delivery is from our warehouse in Dubai Industrial City unless the quotation says otherwise. Risk in the goods passes to you on delivery or collection. Please check the goods on receipt and report any shortage or transit damage in writing within 3 working days.
8. Returns and warranty
Our products are covered by the BERGO® range warranty applicable to each product, as published on this website, and by our Warranty and Returns Policy (BGP-RMA-01), which sets out how to make a claim, the remedies available and what is excluded. Nothing in these terms limits any right you have under the laws of the United Arab Emirates, including Federal Law No. 15 of 2020 on Consumer Protection where it applies.
9. Product information
Product data on this website, in our catalogues and in our technical data sheets is given to the best of our knowledge and may change without notice as products are improved. Dimensions, finishes and colours may vary within normal manufacturing tolerances. Please confirm critical specifications with us before ordering. Catalogue images are illustrative.
10. Intellectual property
The content of this website, including the BERGO® name and logo, the range names, texts, photographs and documents, belongs to BERGO PRO or its licensors. You may download catalogues and technical data sheets for the purpose of specifying and buying our products; any other use requires our written consent.
11. Website use
We aim to keep the website available and accurate but do not guarantee uninterrupted access. We may change or withdraw content at any time. You must not attempt to gain unauthorised access to the website, its data or its users, or use it for any unlawful purpose.
12. Liability
Our liability for any claim arising from a sale is governed by the quotation and our Warranty and Returns Policy. To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, arising from the use of this website or from information on it.
13. Personal data
We process personal data in accordance with our Privacy Policy, published on this website, and with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
14. Governing law
These terms, and every sale made by BERGO PRO, are governed by the laws of the United Arab Emirates. The courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights.
